These terms and conditions govern your use of our website. Please read these terms in full before you use this website. If you do not accept these terms and conditions, please do not use this website. Your continued use of this website confirms your acceptance of these terms.

1. Website access

1.1 It is not necessary to register with us in order to use most parts of this website. However, particular areas of this website will only be accessible only if you have registered.

2 Use of website

2.1 This website may be used for your own private purposes and in accordance with these terms and conditions.

2.2 You may print and download material from this website provided that you do not modify or reproduce any content without our prior written consent.

3. Website uptime

3.1 All reasonable measures are taken by us to ensure that this website is operational all day, every day. However, occasionally technical issues may result in some downtime and accordingly we will not be liable if this website is unavailable at any time.

3.2 Where possible we always try to give advance warning of maintenance issues that may result in website down time but we shall not be obliged to provide such notice.

4. Visitor provided material

4.1 Any material that a visitor to this website sends or posts to this website shall be considered non-proprietary and non confidential. We shall be entitled to copy, disclose, distribute or use for such other purpose as we deem appropriate all material provided to us, with the exception of personal information, the use of which is covered under our Privacy Policy.

4.2 When using this website you shall not post or send to or from this website any material:

(a) for which you have not obtained all necessary consents;

(b) that is discriminatory, obscene, pornographic, defamatory, liable to incite racial hatred, in breach of confidentiality or privacy, which may cause annoyance or inconvenience to others, which encourages or constitutes conduct that would be deemed a criminal offence, give rise to a civil liability, or otherwise is contrary to the law in the United Kingdom;

(c) which is harmful in nature including, and without limitation, computer viruses, Trojan horses, corrupted data, or other potentially harmful software or data.

4.3 We will fully co-operate with any law enforcement authorities or court order requiring us to disclose the identity or other details of any person posting material to this website in breach of Paragraph 1.7.

7.1 We do not accept liability for any loss or damage that you suffer as a result of using this website.

7.2 Nothing in these terms and conditions shall exclude or limit liability for death or personal injury caused by negligence which cannot be excluded or under the law of the United Kingdom.

8. Law and jurisdiction

8.1 These terms and conditions are governed by English law. Any dispute arising in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the Courts of England and Wales.

9. Availability 

9.1 All products are subject to availability. The items in your shopping basket that are not reserved and may be purchased by other customers until we accept your order.

9.2 We try to ensure that we always stock the full product range and will let you know if the product is out of stock. If for any reason beyond our reasonable control we are unable to supply a particular product, we will not be liable to you except to ensure that you are not charged for that product.

9.3 In the interests of all our customers, we may place restrictions on how many of a product you can buy for some products. If you try to buy more than the number of products permitted by any buying restrictions on that product, you will receive an message/email asking you to reduce the number of products you're trying to buy.

10. Acceptance of orders

10.1 
Your order is an offer to buy from us. Once you place you're order, you're receive an confirmation email detailing the products you have ordered and an estimated date for delivery or collection in store, as applicable. Please note that this email is not acceptance of your order by us.

10.2 Nothing that we do or say will amount to any acceptance of your offer until you are sent an email notifying you that we have dispatched a product to you or if you have opted for Store Collection an notifying you that we have dispatched a product to your selected store (as applicable). At this point (when we send the email notifying you of dispatch), a contract will be made between Destination Pet and you for you to buy and us to sell the products that you have ordered from us. Where products are dispatched or made available to collect in store separately, our acceptance of the order in respect of each product takes place when you are notified by email of such dispatch.

10.3 Up until the point the contract is made, you may withdraw your offer in writing via email. After the time the contract is made, you cannot amend your order, however, you may cancel an order as set out in our return and refund policy which forms part of the Terms and Conditions. We may decline to supply a product to you. If we decline to supply a product to you and you have already paid for it, we will give you a full refund of any amount already paid for that product.

1.4 The contract of sale between you and us is in England in the English language.

11. Pricing

11.1 All prices and offers for goods on the website are as advertised from time to time.  The prices are in British Pounds Sterling (GBP) inclusive of VAT where applicable. We reserve the right to cancel any orders placed by you in the circumstance where there are significant pricing inaccuracies.  You will be notified in the event of an order being cancelled.

11.2 We reserve the right to adjust prices before your order has been processed.  You will be notified of any changes requesting your confirmation and agreement before the product(s) are dispatched.

11.3 There may be occasions where the prices of goods sold online differ from those in stores due to special promotions.

12. Payment

12.1 You can make payments for online purchases using American Express, Mastercard, Visa, Visa Electron Switch, Maestro, Delta, Solo and PayPal.

12.2 You confirm that the credit/debit card or PayPal account being used for the purchase is yours or that you have authorisation from the owner to use it on their behalf.

12.3 To protect your card details, all credit and debit card transactions are processed by Klarna and/or PayPal. Validation checks on the card holder and authorisation by the card issuer will be carried out on all credit and debit card transactions. If the card issuer refuses to authorise the payment to Destination Pet, your order will not be accepted and we will not be liable for any non-delivery. For registered customers, we may from time to time store your credit card details on our systems, which will speed up the purchasing process. These details will be fully encrypted and only used to process card transactions initiated by you.

13. Delivery

13.1 We aim to deliver to the majority of postal areas in the UK and Northern Ireland.  There are certain geographical areas that we are unable to make deliveries due to restrictions from our courier. Currently we are unable to ship to the following areas of the UK: Isle of Scilly, and Scottish Islands and Scottish Highlands. We are able to deliver to the Scottish Highlands, Channel Islands, Isle of Wight and the Isle of Man, these remote areas of the UK will incur additional delivery charges. Charges will be added to your checkout once you add the item to your cart.

13.2 Currently we are unable to accept orders for delivery outside of the United Kingdom, including British Force Post Office addresses. 

13.3 Destination Pet also reserves the right to refuse deliveries to addresses such PO Boxes or a communal postal address which may be deemed insecure by our delivery partners.

13.4 We use a variety of delivery methods, depending on the size of the product you order and the speed with which you wish to receive it. For more information on delivery arrangements, times and prices for products supplied by Destination Pet, see delivery information. Some products are delivered directly by our supplier and the supplier will contact you to arrange delivery.​​​​​​​

13.5 Whilst we make considerable effort to deliver all your products within the time periods selected by you for delivery, we shall not be liable if we fail to do so in part or in full due to circumstances beyond our control. We shall contact you to let you know if we are having any problems getting a product to you within that time.​​​​​​​ 

13.6 From time-to-time delivery of certain items will require a signature from a person. The signature will act as proof that you or the person whom the order is addressed has received delivery.

13.7 In the event that no one is available to sign for the items, then depending on the courier your product may be left in your “safe place”, or a notification card will be left at the delivery address with instructions from the courier to either organise collection or redelivery.

14. Incorrect, Missing or Damaged Orders

14.1 If your order arrives incorrect, incomplete, damaged or if you have not received your order within 7 working days of receiving a 'Despatch Confirmation' email, please contact us immediately by emailing orders@destination-pet.com

15. Cancellations & Refunds

15.1 You are entitled to return products for a full refund up to 14 days from the delivery date providing you give us written notice in accordance to our returns procedure.

15.2 Destination Pet will not accept returns of personalised goods, made to measure goods, veterinary medicines, used food, unsealed CDs/DVDs/or other recording media. 

15.3 You must ensure that returned products are sent back unopened, in the original packaging, and they must be in a resalable condition. The cost of returning the products back to Destination Pet is your responsibility, unless the product delivered is not the item that was ordered, faulty or damaged. 

15.4 Under distant selling regulations you are able to cancel this contract, we will provide a full refund of the original purchase price and delivery charge, provided that you have notified us in writing no longer than 14 working days after delivery of the products. This is on the provision that you have provided reasonable care of the products, the products are unused and that the products have returned to Destination Pet in a resalable condition.

15.5 To return your products, Please use the label attached to your invoice inside your order or email us at orders@destination-pet.com for further details.

15.6 Please ensure that you return the products within 7 days of cancellation of the contract. To cancel your order, please provide written notice or contact our customer service team following the instructions on the returns policy. We will process refunds when we have received the returned product. Refunds will usually take 3-30 working days to clear.
